Last updated:

Please read these Terms & Conditions carefully. They set out the terms on which Master Set Builder LLC provides mastersetbuilder.com and the Collection Tracker and sells products to you. They include our Shipping & Returns Policy, Privacy Policy and Exact-Copy Scan Disclaimer by reference, and they contain an arbitration agreement and class-action waiver (Section 18).

1.Acceptance of These Terms

1.1These Terms & Conditions (the "Terms") are a legally binding agreement between you and Master Set Builder LLC ("Master Set Builder LLC," "we," "us" or "our"). They govern your access to and use of mastersetbuilder.com, the Collection Tracker and any related services (together, the "Services"), and every purchase you make through the Services.

1.2By creating an account, using the Services or placing an order, you confirm that you are at least 18 years old, or the age of majority where you live, or that you are using the Services with the consent and supervision of a parent or legal guardian who agrees to these Terms. If you do not agree, do not use the Services.

1.3Before you can place an order, you must tick a box stating that you agree to Master Set Builder LLC's Terms & Conditions. We record the date and time of that agreement, and the version of these Terms in effect, with your order.

1.4Section 18 contains an arbitration agreement and class-action waiver that affect how disputes are resolved. Please read it carefully. You may opt out as described in Section 18.7.

2.Documents Incorporated by Reference

2.1The following documents are part of these Terms and are covered by your agreement to them, including your agreement at checkout: (a) the Shipping & Returns Policy; (b) the Privacy Policy; and (c) the Exact-Copy Scan Disclaimer in Section 8.

2.2If an incorporated document conflicts with these Terms, these Terms control unless the incorporated document expressly says otherwise.

3.Accounts and Security

3.1An account is required to check out and to use the Collection Tracker. Accounts are provided through our authentication provider, Supabase, and you may sign in with a passkey.

3.2You agree to give accurate information and keep it current. You are responsible for keeping your credentials and devices secure, and for all activity on your account.

3.3Tell us promptly at support@mastersetbuilder.com if you suspect unauthorized use of your account.

4.Acceptable Use

4.1You agree not to:

  1. use the Services in violation of any law or the rights of others;
  2. access, scrape, overload or probe the Services by automated means, or attempt to bypass security, bot protection, rate limits or checkout controls;
  3. use bots or other automated tools to buy or reserve inventory, or hold items in a cart or checkout without intent to buy;
  4. submit fraudulent orders, use payment methods you are not authorized to use, or file chargebacks in bad faith;
  5. upload or transmit content that is unlawful, infringing, abusive, misleading or harmful; or
  6. resell or commercially exploit the Services or their data without our written consent.

5.Collection Tracker

5.1Your collection data. The Collection Tracker lets you record cards, sets, conditions, quantities and similar information ("Collection Data"). You are responsible for the accuracy of Collection Data you enter or import.

5.2Values are estimates. Collection values, market prices and set-completion figures are automated estimates based on third-party market data. They may be delayed, incomplete or wrong. They are not appraisals, offers to buy or sell, or financial, investment, insurance or tax advice.

5.3"Complete my set." The Complete my set feature adds cards that are missing from your collection and that we have in stock to your cart. It only adds items to your cart. Nothing is purchased until you review your cart and place an order. Items added this way are not reserved, and availability, condition and price are confirmed only at checkout.

5.4No guarantee of availability. We do not guarantee that any card, set or product will be in stock or offered by us at any time.

5.5License to us. You keep ownership of your Collection Data. You grant Master Set Builder LLC a non-exclusive, royalty-free, worldwide license to host, store, copy, process and display your Collection Data solely to operate, maintain, secure and improve the Services for you. This license ends when your Collection Data is deleted, except for copies kept in routine backups for a limited time or where the law requires us to keep them.

5.6Export and deletion. You can ask for a copy of your Collection Data, or its deletion, by emailing support@mastersetbuilder.com. We will respond within a reasonable time and as required by law. You can also delete individual entries yourself in the Collection Tracker.

6.Orders, Pricing, Errors and Cancellation

6.1Prices, availability, shipping charges and applicable tax are shown in your cart and at checkout before you pay. All prices are in U.S. dollars.

6.2Payments are processed by Stripe. Master Set Builder LLC does not receive or store your full card number.

6.3Placing an order is an offer to buy. An order is accepted when we ship it. An order confirmation email confirms that we received your order; it does not mean we accepted it.

6.4Despite our efforts, listings may contain errors in pricing, description, images, condition or availability. We may refuse or cancel any order, before or after confirmation, if: (a) an item is unavailable; (b) a listing contains a pricing or description error; (c) we cannot verify payment or shipping information; or (d) we reasonably suspect fraud, reselling abuse or a violation of these Terms. If we cancel after you have been charged, we will refund the amount charged for the cancelled items.

6.5We may limit quantities per customer, household or order. Promotional codes are subject to their stated terms and may be changed or withdrawn at any time.

7.Sales Tax

7.1We collect sales tax where required by law. Texas sales tax is currently calculated on orders shipped to Texas addresses, and shipping charges may be included in the taxable amount. Any tax is shown at checkout before you pay. You are responsible for any other taxes that apply to your purchase.

8.Listings, Grading and Exact-Copy Scans

8.1We describe products, including card condition, printing, variant and finish, in good faith and as accurately as we reasonably can. Condition descriptions for ungraded ("raw") cards are our good-faith assessment. They are not a grade from a third-party grading company and may differ from the grade such a company would assign.

8.2For graded cards, the grade is the one assigned by the named grading company. We are not responsible for that company's grading decisions.

8.3Exact-Copy Scan Disclaimer. Scans show the exact copy you'll receive, but image matching and scan quality can vary, so some surface wear, edge whitening or finish issues may not be visible. Mistakes can happen; contact us if anything doesn't match.

9.Binder Tags and Custom Products

9.1Binder tags are made to order. Standard-color tags are priced at $4.00. Custom colors add $1.00 per tag and allow up to three colors, one for each part: the letters and mark, the band and the base. Each tag includes one keyring and one chain.

9.2Colors and previews on screen are representations. Minor variations in color, layer lines and finish are normal for 3D-printed products and are not defects.

9.3Made-to-order and custom-color products are non-returnable unless they arrive defective or are not what you ordered, as described in the Shipping & Returns Policy.

10.Assumption of Risk: Collectibles and Market Prices

10.1Trading cards and other collectibles are bought for enjoyment. Their market value can rise or fall sharply and unpredictably. You acknowledge that: (a) prices on the Services may change at any time, including after you buy; (b) we do not price-match or refund price differences; and (c) we make no representation that any item will hold or increase in value.

11.Shipping, Pickup and Returns

11.1Customer orders are fulfilled by shipment only. Local pickup is not offered for purchases. In-person meetings in the Dallas–Fort Worth area are arranged only when Master Set Builder LLC is buying cards from you.

11.2Shipping, processing times, risk of loss, returns and refunds are governed by the Shipping & Returns Policy.

12.Intellectual Property and Copyright Complaints

12.1The Services, including their design, software, logos, text and original images, are owned by Master Set Builder LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes in line with these Terms.

12.2Master Set Builder LLC is an independent business. It is not affiliated with, endorsed by or sponsored by Nintendo, The Pokémon Company, Creatures Inc. or GAME FREAK inc. Pokémon and related names, images and marks are trademarks of their respective owners and are used only to identify products.

12.3DMCA notices. If you believe material on the Services infringes your copyright, send a notice to support@mastersetbuilder.com or by mail to Master Set Builder LLC, P.O. Box 283, Roanoke, TX 76262. The notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it appears; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or are authorized to act for the owner. We may remove material and end the accounts of repeat infringers.

13.Third-Party Services and Links

13.1The Services may link to or rely on third-party websites and services, such as payment, shipping-carrier tracking and market-price sources. We do not control them and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.

14.Disclaimer of Warranties

14.1Except as expressly stated in these Terms, and to the fullest extent permitted by law, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

14.2We do not warrant that the Services will be uninterrupted, secure or error-free, or that values, prices or other information will be accurate or current. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

15.Limitation of Liability

15.1To the fullest extent permitted by law, Master Set Builder LLC and its owners, members, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, revenue, data or collectible value, arising out of or relating to the Services or these Terms.

15.2Our total liability for all claims relating to the Services or any order will not exceed the greater of (a) the amount you paid us for the order giving rise to the claim, or (b) one hundred U.S. dollars ($100).

15.3These limits do not apply where the law prohibits them, including liability for fraud, gross negligence or willful misconduct.

16.Indemnification

16.1You agree to defend, indemnify and hold harmless Master Set Builder LLC and its owners, members, employees and agents from any claims, losses, damages, liabilities and expenses, including reasonable attorneys' fees, arising out of (a) your misuse of the Services, (b) your violation of these Terms or of any law, or (c) content or Collection Data you submit.

17.Governing Law and Venue

17.1These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-laws rules. The Federal Arbitration Act governs Section 18.

17.2For any dispute not subject to arbitration, you and Master Set Builder LLC agree to the exclusive jurisdiction of the state and federal courts located in Denton County, Texas.

18.Dispute Resolution, Arbitration and Class-Action Waiver

18.1Informal resolution first. Before starting arbitration or a court case, you and we agree to try to resolve any dispute informally. The party raising the dispute must send a written notice describing it and the relief sought: to us at support@mastersetbuilder.com and Master Set Builder LLC, P.O. Box 283, Roanoke, TX 76262, or to you at the email on your account. Both parties will then negotiate in good faith for 30 days.

18.2Binding individual arbitration. If the dispute is not resolved within that time, any dispute arising out of or relating to these Terms, the Services or any order will be resolved by binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. It may be conducted by video, by phone, on written submissions, or in person in Denton County, Texas or the county where you live.

18.3Small-claims exception. Either party may instead bring an individual claim in small-claims court, if it qualifies, in Denton County, Texas or the county where you live.

18.4Other exceptions. Either party may seek injunctive relief in court for infringement or misuse of intellectual property.

18.5Class-action waiver. You and Master Set Builder LLC agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party.

18.6Fees. Payment of arbitration fees is governed by the AAA Consumer Arbitration Rules.

18.7Your right to opt out. You may opt out of this arbitration agreement by emailing support@mastersetbuilder.com within 30 days after you first agree to these Terms. Include your name, your account email and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

18.8Severability. If the class-action waiver is found unenforceable for a claim, that claim must be heard in court, not arbitration, and the rest of this Section continues to apply.

19.Termination

19.1You may stop using the Services and ask us to close your account at any time. We may suspend or end your access at any time if you violate these Terms, if required by law, or to protect the Services or other users.

19.2Sections that by their nature should survive termination will survive. These include Sections 5.5, 6, 10, and 12 through 21.

20.General Provisions

20.1Entire agreement. These Terms, together with the documents incorporated in Section 2, are the entire agreement between you and Master Set Builder LLC about the Services. They replace any prior agreements on the same subject.

20.2Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions stay in effect.

20.3No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.

20.4Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets, or to an affiliate.

20.5Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control. Examples include natural disasters, severe weather, carrier or postal disruptions, labor actions, utility or internet failures, government action, and outages at third-party providers.

20.6Notices. We may send notices to the email address on your account or post them on the Services. Legal notices to us must be sent to support@mastersetbuilder.com and Master Set Builder LLC, P.O. Box 283, Roanoke, TX 76262.

20.7Changes. We may update these Terms. The "Last updated" date shows the latest version, and your order record shows the version you agreed to. Changes apply from the date they are posted and do not apply to orders placed or disputes noticed before then.
